They submit that the Ports Act is a special law dealing with the Ports and constructions of the Jetties and lending piers etc; while Act XXXVI of 2000 is a general law dealing with water bodies in general and in presence of non-obstante clause, the latter general law can not override special law. They submit that the conservator being the only authority under the Ports Act to remove the constructions upon his satisfaction, this Division erred in law apparent on the face of the record in upholding order of removal of the Jetties.
