Compulsory retirement— In the case of major punishment the delinquent officer must be given proper opportunity to defend himself of the charges brought against him— In the case of major punishment the delinquent officer must be given proper opportunity to defend himself of the charges brought against him. The impugned purchasers were made by the purchase Committee consisting of three members and the writ-petitioner had no independent action but no action has been taken against other members though they were equally liable. Furthermore, the appeal and review Committee met in the afternoon of 05.09.2000 in the 73rd meeting of the Board with the direct participation of the members of the appeal review Committee who were also the members of the Board. Their participation in the Baord’s meeting affected the authority of the Board to decide the appeal finally and the decision has obviously prejudiced the respondent herein causing miscarriage of justice. The impugned judgment is based on sound principle of law and needs no interference.
