Nationalization of the College— Both the colleges should be nationalized, as such a decision would serve the greater interest of the locality, ensuring equal and just access to higher education— Since the writ-petitioner’s college fully meets the criteria of বেসরকারী শিক্ষা প্রতিষ্ঠান জাতীয়করণ নীতিমালা ২০১৬, it rightly deserves priority in the nationalization process. Although writ-Respondent No. 8’s college does not meet the required criteria, its inclusion in the nationalization process is not being objected to. However, considering the superior qualifications, larger student body, better academic performance, and infrastructural strength of the writ-petitioner’s college, it has a stronger and more justified claim for nationalization. In the light of these facts, it is evident that the best course of action in the interest of justice and fairness would be to grant priority to the writ-petitioner’s college while ensuring that both institutions are nationalized. Therefore, hold that the High Court Division has correctly disposed of the Rule, as it rightly observed that while the nationalization of writ-Respondent No. 8’s college is not being interfered with, the writ-petitioner’s college is on a better footing and must be prioritized over writ-Respondent No. 8’s college. Therefore, both the colleges should be nationalized, as such a decision would serve the greater interest of the locality, ensuring equal and just access to higher education.
