Upon reading both the provisions simultaneously and construing the same in the context of the fact of this case it transpires that the fact of this case does not come within the scope of law as discussed above since no question of ‘transfer’ as prescribed in section 2 is involved here. Moreover, there is no iota of evidence which shows that the Government has any subsisting interest in the suit land. Therefore, non impleading the Government in the suit was not at all a material factor and for that reason the argument of the learned Senior Advocate Mr. A.J.
