From the statements in the writ petitions it is found that the writ petitioners were eligible for regularization to their respective posts as per Rule 4 of Rules, 1981 on or before 10th May, 1998, prior to the promulgation of Rules of 2000. The writ petitioners regularization will be decided as per rule 4, and their seniority and promotion will be governed by Rule 8 of the Rules, 1981. The Bangladesh Public Service Commission recommended for regularization of the writ petitioners services as per Rule 6(5) of Rules, 2000 presumably on the ground that since the Rules of 1981 have been repealed, the Rules of 2000 will hold the field. There is totally based on misconception of law. The Writ Petitioners regularization will be decided as per rule 4, and their seniority and promotion will be governed by Rule 8 of the Rules, 1981.
