The Appellate Division observed that a reading of the Ain of 2005, in general, and section 10 thereof, in particular, the High Court Division found that the proviso to sub-section (2) of section 10 has waived one category of teachers from such mandatory requirement of registration, certification and enlistment under the new law, who fulfill. The High Court Division found that if the criteria are met by a particular teacher on the commencement of the said Ain of 2005, that is, on 20.03.2005, he would not require to be certified, registered and enlistment as per the previsions of the said Ain. The High Court Division noted that since no body disputed the validity of the appointment of the writ-petitioner, there was no reason as to how the department through the impugned memo mentioned the absence of those requirements mentioned above. The findings arrived at and the decision made by the High Court Division having been based on proper appreciation of law and fact do not call for interference. Accordingly, this civil petition is dismissed.

The writ petitioners moved in the High Court Division to get declaration that the imposition of the age limit of 35 years is not binding upon the writ petitioners since they obtained their certificates before imposition of such age limit and their claim should not be regulated by the "জনবল কাঠামো ও এম.পি.ও নীতিমালা" and age limit imposed.
"বেসরকারী শিক্ষক নিবন্ধন ও প্রত্যয়ন কর্তৃপক্ষ আইন-২০০৫" did not allow the NTRCA to appoint any one in any Non- Government Educational Institution. Its only duty is to prepare list of qualified candidates with regard to the number of vacancies of teachers which are fallen vacant in course of the year and to publish the same accordingly.
Provision of the Clause No.11.6 of the "বেসরকারী শিক্ষ প্রতিষ্ঠানের (স্কুল ও কলেজ) জনবল কাঠামো ও এম.পি.ও নীতিমালা-২০১৮ " and the provision of Clause No.11.6 of the "বেসরকারী শিক্ষ প্রতিষ্ঠান (মাদ্রাসা) জনবল কাঠামো ও এম.পি.ও নীতিমালা-২০১৮ " and the provision of Clause No.14.7 of the "বেসরকারী কারিগরী শিক্ষ প্রতিষ্ঠান জনবল কাঠামো ও এম.পি.ও নীতিমালা-২০১৮ " and the provision of Clause No.14.6 of the "বেসরকারী শিক্ষ প্রতিষ্ঠান (ব্যবসায় ব্যবস্হাপনা) জনবল কাঠামো ও এম.পি.ও নীতিমালা-২০১৮ " are prospectively legal but not applicant to the petitioners.
