Afresh trial––
To hear and dispose of the suit after serving fresh notices upon the defendants as to amend the plaint is allowed filed by the plaintiff– The judgment and decree dated 16.06.2016 passed by the High Court Division in First Appeal No.393 of 2015 and the judgment and decree dated 17.09.2015 passed by the 1st Court of Joint District Judge, Dhaka in Title Suit No.09 of 2010, both are set-aside. The suit be sent back on remand to the trial Court for trial afresh in accordance with law.
The plaintiff is allowed to file an application to amend the plaint.
