Self-defense usually refers to the use of violence to protect oneself/property and is a possible justification for this otherwise illegal act. Mere fact that pleas of self defence was not raised by an accused or that in his statement under section 342, Cr.P.C. he had not stated all facts relating to plea of self defence does not create an insurmountable hurdle in the way of accused – benefit of right of self defence can be given to an accused person if it can be gathered from facts and circumstances of the case. …..
