The family court means a Court having the jurisdiction to hear matters in
relation to Family Law disputes.
It deals with family law disputes, particularly: divorce, issues relating
to children, maintenance, guardianship, etc.
Family courts are established in Bangladesh under section 4 of the Family
Courts Ordinance 1985. Their jurisdiction extends to the matters enumerated
in section 5 of the Ordinance, subject to the provisions of the Muslim
Family Laws Ordinance, 1961. The matters so enumerated include, dissolution
of marriage; restitution of conjugal rights; dower; maintenance;
guardianship and custody of children.
The Family Courts Ordinance has not taken away any personal right of any
litigant of any faith. It has just provided the forum for the enforcement
of some of the rights as is evident from section 4 of the Ordinance. …..
