Generally agent is one who is appointed to bring his principal into
contractual relationships with other persons. He is the one who acts on
behalf of his principal i.e. the person he is representing. An agent is a
person employed to do any act for another or to represent another in
dealings with third persons. The person for whom such act is done, or who
is so represented, is called the principal. ….. ( Section 182, the

An agent is not himself a party to any contract entered into by his
principal through him with the third party if he posed as a disclosed
agent. As such no question of his liability to such third party for any
