Title Duty of the Court
Details

It is the duty of the Court to award proper sentence having regard to the nature of the offence and depending upon the degree of criminality, the manner in which it was committed and all attended circumstances. The occurrences of killing of intellectuals were committed with the extremely cruel and beastly manner which demonstrated index of the depraved character of the perpetrators. It will be a mockery of justice to permit the accused to escape the extreme penalty of law when faced with such evidence and such cruel acts. The Judges are carrying out the duty under the Law. The sentence awarded by the Tribunal for intellectuals killings is not disproportionate in view of the nature of charge and evidence adduced.
