From a combined reading of the provisions of Sub-Regulation (3) of Regulation 46 of the Service Regulations of 2011 and Sub-Rule (2) of Rule 22 of the Government Servants (Discipline and Appeal) Rules, 1985, the position that emerges is that the appellate authority will pass such orders as it deems just and equitable, regard being had to the facts and circumstances of the case.
