Transfer of a property to meet expenditure of marriage of sister does not construe usufructuary mortgage as contemplated under section 6 of the said Act. From the provision of section 6 it further appears that, if any building (Aojrf) is situated on the land in question section 6 of the Act cannot be invoked. If an owner of agricultural land being affected in natural calamities or being unable to maintain one's livelihood sells any property, i) he may seek aid of Section 6 of Bangladesh Rin Shalishi Ain 1989 otherwise the transaction cannot come within the purview of Section 6 of Act. before the Board on 18.5.90—the High Court Division upheld the findings of the courts below that the application under section 7 of the Act was banned by time.
Held : An application cannot be presented to the Board unless the sitting of the Board, actually takes place after the collector concerned notifies about the place, date, and time of the sitting of the Board—on 4.1.90 from which date the Board started functioning—the application of the defendant under Section 7 of the Act was not time barred.
